Department of Industrial Works Announced New Hazardous Substance Act Effective In October.
31-5-2019–Department of Industrial Works revealed that the new hazardous materials laws will be effective this October.
Confident that it will be ble to control the operation of hazardous substance business efficienctly and can order the operator who do not comply with the law to immediately remove dangerous substances if the storage will cause harm.
Mr. Thongchai Chavalitphichet, Director-General of Department of Industrial Works (DIW), Ministry of Industry revealed that the Hazardous Substance Act (No. 4) BE 2562 (CE 2019) was announced in the Royal Gazette on 30 April, 2019 and will come into force on 27 Oct 2019 onwards.
This is good news for the community of entrepreneurs and the huge economy of the country since the new Hazardous Substance Act will help drive the mechanism to control hazardous substances effectively both regulating rules and increasing effective supervision measures, including controlling the introduction of hazardous substances not to be left to cause harm in the country.
At present, there are more than 3,000 industrial hazardous substance operators throughout the country.
In 2018, the Department of Industrial Works had issued approximately 2,000 hazardous material registration certificates, issued licenses for production, import, export and possession of hazardous materials Type 3, about 5,500 copies, issued a notification about the operation of hazardous substances of type 2, about 1,000 copies.
Any operator is hazardouus manufacturer who has been excluded by the applicant. The Hazardous Substance Act will not let it be excluded.Therefore, called them to check and comply with the hazardous substance laws as well.
“At present, the Thai economy continues to grow together with the policy of investment promotion and production as a result reflexing by Thai industrial sector that has expanded accordingly.
Therefore producing various products need to use chemicals as a component, thus increasing the trend of importing dangerous chemicals.Although these chemicals are useful, they may cause adverse effects on human health, the environment, as well as the country’s economy.
If there is no appropriate control measures The Department of Industrial Works is therefore confident that this new Hazardous Substance Act will help to increase the efficiency in the formulation of hazardous substances control measures of relevant agencies as well, “said Mr. Thongchai.
Mr. Thongchai added that for details of amendments and additions to the new law, it is important that there is a separate definition of passing out of the imports.
Thus able to issue rules and control methods that are suitable for the nature of such operations which will give priority to safety and prevent throwing away the hazardous substance without being able to identify the occupant of the dangerous substance.
From the previous importing hazardous materials, it was found that some parts of the demand for hazardous materials was used in the study, analysis, research and development.
To create innovations that will be used in national development, including the private sector wants to make Thailand the center of regional research analysis , which this law provides an opportunity for the exclusion of legal compliance in some cases, if the hazardous substance is used in the case mentioned.
In addition, there is a waiver for hazardous materials that need to be re-import or re-export.
The agency must frame the rules and conditions by considering the need for further exemptions or waivers , while also giving the authority to the responsible person to order the importer or import through to send dangerous substances that do not comply with this law out of the Kingdom immediately, if the storage may be dangerous and unreasonable for destruction or management in the country.
“In the case of hazardous materials that have been insured the damaged, This law adds additional principles regarding the payment of initial damages to compensate those who have been damaged and the aid agency moving or eliminating the damage without waiting for proof of liability.
Then the insurer must proceeded to recourse to the person who caused the damage, “said Mr. Thongchai.
For the advertisement of hazardous materials, especially hazardous materials used in homes or agricultural used, regulatory agencies will issue clear guidelines and guidelines for advertising and if the operator has
doubt whether their advertising is correct, they who inquire and discuss with the agency before advertising that causing the people to receive fairness from advertising more dangerous materials.
